Your rights under Marsy's Law
Approved by Florida voters in 2018 and codified at Article I, Section 16(b) of the Florida Constitution.
- To be treated with fairness, respect, and dignity, and to be free from intimidation and harassment.
- To reasonable protection from the accused and from anyone acting on the accused's behalf.
- To reasonable, accurate, and timely notice of public proceedings, including any pretrial release proceeding.
- To be present at and heard in proceedings involving pretrial release, plea, sentencing, and release.
- To confer with the prosecuting attorney about the case.
- To full and timely restitution.
- To be informed of the release, escape, or death of the accused or convicted person.

Notification and protective orders
Pretrial release notification
Ask the State Attorney's victim-witness unit to register you for notification and confirm your contact information in the case file. Many counties also participate in automated custody-status notification. Notification timing varies by county records system, so registering in more than one place is prudent.
Protective orders and conditions
A judge may make no-contact provisions, stay-away distances, surrender of firearms, and electronic monitoring conditions of release. Separately, you may petition for an injunction for protection. Violations of release conditions should be reported to law enforcement and the prosecutor immediately.
